This is a one-hour presentation on the HIPAA Privacy and Security Rules and how they affect the retrieval, retention, and destruction of Protected Health Information during the litigation process. The new 2009 HITECH regulations are also covered and the presentation highlights the administrative, technical and physical safeguards some attorneys must now follow.
The elements required for a valid authorization, some common myths and facts regarding the HIPAA rules, and the Code of Federal Regulations mandates for litigation are all reviewed. Bound HIPAA desk references are provided to all attendees. The CLE is presented via PowerPoint and is aimed at attorneys and other legal professionals involved in medical malpractice, products liability, and mass tort litigation.
